Hostway “iPhone Giveaway” Sweepstakes Official Rules

No Purchase Necessary To Enter or Win! A Purchase will not increase an individual’s chance of winning. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The Hostway “iPhone Giveaway” Sweepstakes ("Sweepstakes") will begin at 12:00 am Eastern Time (ET) on June 17, 2008 ("Sweepstakes Start Date"), and end at 11:59 pm ET on September 17, 2008 ("Sweepstakes Period"). Sweepstakes is sponsored by Hostway Services, Inc, 100 N. Riverside Plaza, 9th Floor, Chicago, IL 60606 (the "Sponsor") who is solely responsible for all aspects of this sweepstakes.

Eligibility:

Sweepstakes is open only to individuals who are 18 years of age or older as of “Sweepstakes Start Date”, and are legal U.S. residents located in the U.S. or legal Canadian residents (excluding Quebec) located in Canada. Employees, officers and directors of Sponsor, its parent company, affiliates, subsidiaries, agents and advertising and promotion agencies, (collectively including Sponsor, “Sweepstakes Entities”) as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not), are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed or otherwise restricted by law. Void where prohibited.

How to Enter:

1.) Sign up for an Exchange hosting account (by phone or online at www.hostway.com) and you are automatically entered into the Sweepstakes. If an order is placed for a company, the person placing the order shall be the individual entered in the Sweepstakes. Every order placed during the Sweepstake period will receive a Sweepstakes entry. All orders must be received by 11:59pm ET on September 17, 2008. 2.) Enter by hand printing on a 3" x 5" card, in black or blue ink, your first name, last name, email address (if available), mailing address, city, state, zip, phone number with area code first, date of birth and the words “Hostway iPhone Giveaway Sweepstakes” and mail the 3" x 5" card in a first class stamped envelope to: Hostway “iPhone Giveaway” Sweepstakes c/o 90 Rockwood Place, 1878 East Ave. Rochester, NY 14610. The mail-in entries must be postmarked by September 17, 2008 and received by September 24, 2008. Each properly completed and received card will receive one entry into the Sweepstakes drawing. Limit one card per envelope per person per day and each envelope must be mailed separately.

All required information must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of an entry. The use of automated entry devices is prohibited and no mechanically reproduced entries are allowed; all such entries are void. Sweepstakes Entities are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, misdirected, stolen, postage-due registrations, entries or mail. Sponsor reserves the right to disqualify any person that submits more than maximum allowed entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. By participating, you consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes.

Prizes:

Three (3) Grand Prize winners will receive a 16 GB iPhone. The Approximate Retail Value (ARV) of each Grand Prize is $ 299. The prize is subject to availability, and substitutions by winners are not permitted. The Prize is not exchangeable, transferable, or redeemable for cash. Sponsor reserves the right, at its sole discretion, to substitute any prize package with another prize of equal or greater value. All decisions by Sponsor as to the prize winners and prize are final.

Drawing and Notification:

The potential Grand Prize Winners will be selected, from among all eligible entries received, in a series of 2008 random drawings conducted on or about July 25, August 25 and September 25, by the American Sweepstakes & Promotion Co. (“the Administrator”), an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. Potential winners will be notified by phone and/or mail. Upon initial notification and verification of potential Grand Prize winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice.

Prize Conditions:

The Winner is solely responsible for all applicable federal, state, and local taxes associated with the receipt of the prize. If a Canadian citizen wins the prize they will be required to answer, unaided, a mathematical skill-testing question. If a potential winner from Canada cannot be contacted and the skill test administered within three (3) days of notification, or the question is not correctly answered, the prize will be forfeited and an alternate winner will be selected. Each winner may be required to sign an Affidavit of Eligibility and Liability/Publicity Release and return it within 14 days of written notification by mail or prize may be forfeited and an alternate potential winner selected. Return of any prize notification as undeliverable will result in disqualification and an alternate winner will be selected. The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited by law or Sponsor’s Privacy Policy) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.

Terms & Conditions:

This Sweepstakes is subject to all applicable federal, state, and local laws. By entering the Sweepstakes, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and its and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules.
